Acceptable Use Policy

This Acceptable Use Policy (“AUP”) sets out what is and is not permitted on the FlyB platform. It forms part of the Terms of Use, and terms defined there have the same meaning here.

It applies to you, to everyone you invite to your organisation, to everything you publish through FlyB, and to everything you send through it.

Breaching this policy can lead to content being removed, to your account being suspended, and to termination without refund. Section 9 explains how we enforce it.


1. The principle

FlyB gives you the tools to publish, to contact people and to sell. Those tools reach real people, and their misuse damages the people reached, other FlyB customers who share our sending and hosting reputation, and FlyB itself.

The rule behind everything below is simple: use FlyB for your own legitimate business, with people who agreed to hear from you, in a way you would be comfortable explaining.


2. Prohibited content

You must not use FlyB to create, host, publish, store, distribute or link to content that:

Is unlawful or harmful

  • breaches any applicable law or regulation;
  • infringes or misappropriates a copyright, trademark, patent, trade secret, right of publicity or other right;
  • is defamatory, harassing, threatening, or incites violence or self-harm;
  • promotes hatred or discrimination on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation or age;
  • sexually exploits or endangers a minor — this is reported to the authorities, always;
  • is sexually explicit, or promotes prostitution or human trafficking.

Is deceptive

  • impersonates any person, business or organisation, or misrepresents your affiliation with one;
  • is a phishing page, a fake login screen, a fake storefront or a counterfeit brand site;
  • promotes a pyramid scheme, a Ponzi scheme, a matrix programme, a “get rich quick” offer or a fraudulent investment;
  • makes false or unsubstantiated claims about earnings, health outcomes, results or guarantees;
  • uses fabricated reviews, testimonials, endorsements or trust signals.

Is dangerous or restricted

  • malware, spyware, ransomware, exploit kits, credential stuffing tools or any code designed to damage or gain unauthorised access to a system;
  • the sale of illegal drugs, controlled substances, prescription medicines without authorisation, weapons, explosives, stolen goods or stolen data;
  • unlicensed gambling, unlicensed financial services, or any activity requiring a licence you do not hold;
  • content prohibited by the terms of a payment or messaging partner you use through FlyB, including Stripe’s restricted business list and Meta’s commerce and messaging policies.

3. Prohibited conduct

You must not:

  • share account credentials or API keys, or let anyone use your account who has not been invited to it;
  • circumvent, disable or interfere with any security feature, usage limit, plan limit or Flight metering mechanism;
  • create multiple accounts to obtain free allowances, promotional Flights, trials or affiliate rebates you are not entitled to;
  • reverse engineer, decompile or attempt to extract the source code, prompts, model weights or internal logic of the Services;
  • use the Services, their outputs or their prompts to build, train or improve a competing product or model;
  • scrape or automatically harvest data from the Platform or from any User Site, other than through the public API within its documented limits;
  • resell the Platform as a standalone product, or operate it on a time-sharing or service-bureau basis. Building and hosting sites for your own clients is expressly permitted;
  • probe, scan or test the vulnerability of the Platform without written authorisation, or breach any authentication measure. Responsible disclosure is welcome through the channel in security.txt;
  • place a load on the Platform that degrades it for others, including denial-of-service traffic, uncontrolled automation and abusive API polling;
  • use the Services to relay traffic, host files unrelated to your site, or operate as general-purpose storage or a proxy.

4. E-mail, Messaging and Anti-Spam

This is the section that most often leads to a suspension. FlyB has a zero-tolerance policy on spam.

4.1 You need a lawful basis for every recipient

Every person you e-mail or message through FlyB must be someone you have a lawful basis to contact under the law that applies to them — consent, an existing customer relationship, or another basis recognised by the GDPR, the LGPD, CAN-SPAM, CASL or the equivalent local rule.

4.2 Prohibited lists

You must not import or send to lists that were purchased, rented, leased, swapped, scraped, harvested or otherwise acquired from a third party. That a business published its address does not, by itself, make it lawful to market to.

4.3 Every message must

  • include a clear, working unsubscribe link that is honoured immediately and permanently;
  • identify you accurately as the sender, with a valid physical or business address where the law requires one;
  • carry a truthful subject line that reflects the content;
  • use accurate header and sender information, and not disguise its origin;
  • be sent from a domain you are authorised to send from.

4.4 You must not

  • re-add or re-import a contact who unsubscribed;
  • use a different template, campaign or account to reach someone who opted out;
  • send to addresses that hard-bounced or generated a spam complaint;
  • use deceptive routing, open relays, or a sender identity that is not yours;
  • buy engagement, or use tactics that inflate open or click rates artificially.

4.5 Deliverability metrics

Sustained high bounce rates or spam complaints put every FlyB customer’s reputation at risk. E-mail campaigns include automatic safety limits that stop a campaign on their own, and we may additionally suspend sending on an account whose metrics threaten our standing with e-mail providers, carriers or partners.

4.6 WhatsApp and messaging

The WhatsApp integration is subject to Meta’s own Business Messaging Policy in addition to this AUP. Breaching Meta’s rules can result in your number being restricted by Meta, which is outside FlyB’s control and gives rise to no refund.

You may only connect a number you are entitled to use, on a Business Portfolio you administer. Because the integration runs in coexistence — the number stays live in the WhatsApp Business app — connecting one gives FlyB, and anyone you grant access to your organization, sight of the conversations carried on it. Making sure that is lawful and disclosed where your local rules require it is your responsibility.

WhatsApp Web. A number linked through WhatsApp Web is subject to WhatsApp’s Terms of Service and to every rule and restriction of WhatsApp Web, not to the Business Messaging Policy alone. It has no templates and no 24-hour window, which makes how you use it entirely your responsibility: do not use it to send bulk, unsolicited or repetitive messages, to message people who did not ask to hear from you, or to evade a restriction WhatsApp placed on a number. WhatsApp may disconnect, limit or ban such a number at its own discretion, which is outside FlyB’s control and gives rise to no refund, and FlyB may switch the integration off for an account whose use puts other customers’ numbers at risk.

Automated messages are your messages. Where you configure message automation rules, every message they send is sent on your behalf, from your number, and is subject to Meta’s policy and to this AUP in exactly the same way as one your team types. You are responsible for the audience each rule reaches and for having a lawful basis to message them; FlyB does not review the rules you write. The controls that keep a rule from over-messaging somebody — once per contact, a minimum gap between messages, and quiet hours — are yours to set.


5. Artificial intelligence

You must not use FlyB’s AI features to:

  • generate content that would breach section 2 if you had written it yourself;
  • generate deepfakes, synthetic likenesses or synthetic voices of a real person without their consent, or any content designed to deceive as to authorship or authenticity where that deception is unlawful;
  • generate content that impersonates a real person, brand or publication;
  • produce output for high-risk decisions — medical, legal, financial, employment, credit, insurance, housing or safety-critical — without qualified human review;
  • present AI-generated content as human-authored where doing so is unlawful or breaches a rule that applies to your sector;
  • attempt to extract the underlying prompts, system instructions or model weights of a FlyB AI feature; or
  • generate content at a volume or in a pattern designed to exhaust or resell the underlying model capacity.

Features that run on your own provider account — the AI video and image generators — are additionally subject to that provider’s own policies. See Terms of Use, section 8.6.


6. Data you place in FlyB

  • You must have a lawful basis for every person whose data you hold in FlyB, and must give them the information the law requires.
  • You must honour their rights of access, correction and deletion. FlyB provides the tools; exercising them for your own contacts is your responsibility.
  • You must not upload the categories of data prohibited by Terms of Use, section 11.3 — health information subject to HIPAA, card or bank credentials outside the Stripe checkout, government identity numbers, or biometric data.
  • You must not use another customer’s data, or data obtained by exploiting a vulnerability, for any purpose.

7. Selling through FlyB

You are the merchant of record. You must:

  • describe accurately what you sell, at what price, and what is included;
  • state your refund, cancellation and delivery terms before purchase;
  • publish your own terms of sale and privacy notice where the law requires them;
  • comply with consumer-protection law in every market you sell into; and
  • sell nothing prohibited by section 2 or by Stripe’s restricted business list.

8. Affiliate program

Prohibited affiliate conduct is listed in Terms of Use, section 14: self-referral, harvested accounts, brand bidding, misrepresentation, cookie stuffing, incentivised or automated signups, and promotion through spam.


9. How we enforce this policy

9.1 What we may do

Depending on the severity, we may: contact you and ask you to fix it; remove or disable specific content or a specific User Site; suspend a feature, a user or the whole account; terminate the agreement; withhold or reverse affiliate rebates; and report the matter to law enforcement or to an affected third party.

9.2 How we choose

Where the breach is capable of being fixed and is not causing ongoing harm, we will normally contact you first and give you an opportunity to correct it.

Where the breach involves child exploitation, active phishing or malware, an ongoing security threat, active spam, or exposes FlyB or others to immediate legal or reputational harm, we act immediately and without prior notice.

9.3 Consequences

Content or a site taken down for breach may be restored once the breach is remedied. Termination for breach means the loss of access to your data and your sites, the forfeiture of remaining Flights, and no refund — see Terms of Use, section 16.

9.4 Appeals

If you believe an enforcement decision was mistaken, write to [email protected] with your account e-mail and an explanation. We will review it and answer. We aim to be proportionate, and we would rather you fixed a problem than lost your account.


10. Reporting abuse

If you believe someone is using FlyB in breach of this policy — a phishing page hosted on our infrastructure, spam sent through us, infringing content, or anything else — report it to [email protected] with the URL and a description. Copyright complaints have their own process in Terms of Use, section 9.6.


11. Changes

We may update this policy as new forms of abuse appear. The version and effective date at the top identify the current one, and material changes are notified as described in Terms of Use, section 1.3.
